ROLE OF ARBITRATION IN DEBT RECOVERY

ROLE OF ARBITRATION IN DEBT RECOVERY

What is Debt Recovery?

is the contract you signed with the original creditor which allows them to recover money for a loan after your account has defaulted. The creditor hires a third party, known as a collection service, to focus on collecting the past due amount owed. Debt recovery is important because it is directly correlated that is linked to your credit score.

Arbitration is the procedure that is used for the recovery of bad debts. Many people get into contracts and fail to understand about the arbitration procedure and end up being a miser. To avoid this situation here are some advantages & disadvantages of having an arbitration clause in your contract agreement, how it is invoked, and how it works. If your credit contracts require that disputes if any arise will go through arbitration, debt collectors can begin that process to try to collect the debt.

  Arbitration Vs. Mediation
Posted by: Samoya - 05-26-2021, 01:41 PM - Forum: Arbitration information - No Replies

What is the difference between Arbitration and Mediation?

Arbitration and mediation are two very different processes that allow parties to resolve disputes outside of court. Mediation involves a facilitated negotiation, whereas arbitration involves a third party decision-maker which is known as the arbitrator.

  Internationalizing Domestic Arbitration

How International Arbitration Practices Can Improve Domestic Construction Arbitration

Arbitration is simple. Parties select a person or persons — the arbitrator(s) — whose expertise or judgment they trust to resolve their differences in a privatized forum. After each party puts on their case, the arbitrator(s) consider the arguments and evidence and renders a binding decision.

Given the simplicity, informality, and efficiency offered by arbitration — as compared to courts of law — it is easy to understand why arbitration has been a readily accepted approach to dispute resolution around the world. This appeal has been especially true for the construction industry, where arbitration has become the predominant form of dispute resolution...

Rethinking the Boilerplate: Alternative Dispute Resolution Procedures in Construction Contracts

Due to the legal complexity of construction contracts, most courts don't have the experience or preparation skills needed to handle such cases. Mediation and arbitration are the two most commonly used Alternative Dispute Resolution (ADR) methods to resolve these disputes.

  Home debt dispute

Here is a previous question that was asked by *** (Identity withheld for privacy reason)

I have debt because I haven't paid it yet. Hello mam, is there no charge for this when I consult with you? I don't have any payment right now so I'm asking. I owe home credit and I can't pay it because of the pandemic, I have a small business and it was affected.

The agent always comes to my house and charges me and says he will give me a demand letter. What do I do if the agent gives me a demand letter? His contract is 36 months, but I only have 18 months to stop because of the pandemic.

A dispute with Bellco credit Union with possible fraud. Customer seeking arbitration
Posted by: Samoya - 05-25-2021, 01:09 PM - Forum: Past or Current cases - No Replies

I contacted my bank regarding unauthorized transactions in my accounts. Money movement not initiated by myself. My credit union waited 1 1/2 months before closing my accounts and investigating. They then told me it was my fault and I lost over 50k. I’m now trying to fight for my rights regarding regulation E, EFTA, and identity theft, and credit fraud that has left me in a horrible situation financially and mentally. It says that I have to resolve disputes via arbitration. I have lost so many rights as a consumer for issues that could have been dealt with before I lost everything and my ability to refinance and credit score and ability.

I first mentioned it to the credit union on June 23, they didn’t freeze and close my account until August 13th. I was told that they didn’t feel it was fraud since nothing was stolen. The teller at the bank said that the bank is moving money all the time. I didn’t believe that. I filed a reform with the fbi due to the amount that was taken as well as attempting one police station where I suspect the money was being taken as well as the city where my bank is, not to mention several letters to different financial accountability businesses.
