  Social Security Check
Posted by: Samoya - 06-04-2021, 12:10 PM - Forum: Past or Current cases - No Replies

Here is a previous question that was asked by ***(Identity withheld for privacy reason).

My student loan (mid-1990's) which was originally about 11,000.00 is now 44,000. I have paid on it over the years but not regularly. I could never afford the high monthly payments. I work in a low-paying field (social services) and was a single parent making 20,000.00 for many years. Now they want to do offsets. I will retire in a few years. Can they offset my social security check? I would really like your advice. They are highway robbers. Thanks

  42 USC § 1983 action
Posted by: Samoya - 06-04-2021, 12:07 PM - Forum: Past or Current cases - No Replies

Here is a previous question that was asked by ***(Identity withheld for privacy reason).

How do I obtain legal help for a meritorious 42 USC § 1983 action that has passed the 1915(a) frivolous screening, and that the US marshals have served 12 state officials/defendants for admittedly irresponsibly exposing me to, and infecting me with the most dangerous drug-resistant strain of tuberculosis TB, prescribing me the appropriate 6 month series of anti-TB medication/treatment, but only giving/providing me with 2 months’ worth of (and it is a well-known medical fact that partial treatment is much more dangerous than no, treatment at all, as it allows the latent TB germ in the body to mutate into further resistant to treatment strain) and that I have been begging, pleading and formally grieving for the full series of prescribed treatment to preserve my life since 2010 (well over a decade) and these same said officials adamantly refuse to provide it!  I am beginning the discovery stage, and am in desperate need of professional help and my life may be endangered of death!

USAC and affiliates obtained a settlement.

  Belvilla Booking Dispute
Posted by: Nerine - 06-01-2021, 01:01 PM - Forum: Past or Current cases - No Replies

Here is a previous question that was asked by ***(Identity withheld for privacy reason).

I would kindly ask you for your help with the following situation. I booked my holiday (from Austria) via the agency "Belvilla" last year (the agency´s head office is registered in Netherland) and paid the reservation deposit in the amount of 30% of the total booking payment. Due to family reasons, I had to cancel the holiday 2 months ago by accepting a fact that I will have to pay a cancellation fee based on the cancellation policy in the contract (2 months before the trip). In the cancellation policy, they have stated the following "For the cancellation up to the 42nd days prior to commencement of the first day of stay: 10% of the rent". However, they sent me the email with an explanation on the cancellation fee that I have to pay 10% of the first term and 10% of the second term + booking fees which make the cancellation fee much higher, of course. I also asked them to send me a link with reference to this charges split method - of course, I have not received any response. Secondly, they informed me that they will refund the amount within 12 weeks but according to their policy in "Terms and conditions", they are obliged to refund within 14 days. Now it's been almost 8 weeks w/o a refund. I sent them an email, but without any response. Could you please advise how to proceed since the head office of the agency is placed in Netherland? Thank you very much! Regards.

KC auto dealer wins arbitration case at Missouri Supreme Court

The Missouri Supreme Court ruled that lower courts must enforce arbitration agreements, even if the underlying contract is void under state law.

The Missouri Supreme Court ruled that lower courts must enforce arbitration agreements, even if the underlying contract is void under state law.

The ruling is related to a case involving Lashiya Ellis, who in 2013 bought a new car from Jeremy Franklin Suzuki of Kansas City, which failed to pass title to her for the new vehicle. Missouri law states that it’s unlawful to buy or sell a motor vehicle without the transfer of certificates of ownership. So Ellis argued that because the sale of the vehicle to her did not include a title, it should be voided, and she petitioned the court for damages.

Arbitration of Massachusetts Car Accident Claims

Given the high number of Massachusetts residents injured each year in car accidents, a number of these people file claims for their damages.  One method of resolving these claims is through arbitration. Understanding this part of the personal injury legal process is important for anyone that may be involved in possible arbitration of a car accident claim in Massachusetts.

  What is Family Arbitration?

What is family arbitration?

Family arbitration is a way of resolving disputes between separating couples, whether or not they are married. Family arbitration can help with disagreements relating to money and property, and arrangements for children.

The purpose of arbitration is to reach a final decision about the dispute, which will be binding upon the parties involved. In this way, arbitration differs from mediation. In mediation, the purpose is to reach an agreement through a process of negotiation. In arbitration, the aim is not to reach a negotiated agreement, but rather to have someone else make a final decision for you. This is crucial in the cases where negotiation does not succeed, and both parties need a fixed outcome so they can move on with their lives...

PROS AND CONS OF EMPLOYMENT ARBITRATION
Posted by: Samoya - 05-27-2021, 12:52 PM - Forum: Arbitration information - No Replies

TO ARBITRATE OR NOT TO ARBITRATE

This article addresses the pros and cons of employment arbitration, gives a snapshot of applicable court decisions and statutes as they affect employment arbitration in North Carolina, and suggests practical advice to both litigants and arbitrators involved in arbitrating employment disputes.

1. PROS AND CONS OF EMPLOYMENT ARBITRATION

Conventional wisdom says that arbitration is faster, cheaper, and more confidential than litigating employment cases in court.  Faster in that disputes can be addressed and rulings made in a timelier manner than the traditional court process.  Cheaper in that arbitration usually has a quicker timetable and is less involved than lawsuits in the court system.  More confidential in that arbitration hearings are private while court cases are generally public.

  Immigration for minor
Posted by: Nerine - 05-26-2021, 09:34 PM - Forum: Past or Current cases - No Replies

Here is a previous question that was asked by ***(Identity withheld for privacy reason).

My son is in Hong Kong with a PhD. in education. His wife is a Filipino. He is a US citizen and the offspring has both HK & US citizenship. He is in an unfiled separation/divorce situation hoping to get an agreement, but she will not budge. He has an attorney in HK. He is CURRENTLY using a mediator in HK to come to some form of agreement over an offspring minor prior to filling anyplace. The offspring is a US & HK citizen. Perhaps(?) he was doing work for the State Dept or other entity. Senator Marco Rubio has issued an emergency order for him and his family to the immediate evacuation of H.K. with the concern of "he and his family are in immediate danger of life". A green card will be issued to her upon his wife's entry to the US. To make a very long story short, his soon-to-be-ex will not come to the US, but that still leaves his offspring with his wife who faces
"death" and his offspring! I can provide any paperwork needed from Sen. Rubio's office or the State Dept. with the death warning. My question is, is there a method in the madness to get a US court order for the minor to get her out of HK and harms-way in HK to come to the US without her mother's permission and/or that HK authorities at the airport will abide by? Any ideas? If you feel you can help, we will retain you.

  Divorce Dispute
Posted by: Nerine - 05-26-2021, 09:29 PM - Forum: Past or Current cases - No Replies

Here is a previous question that was asked by ***(Identity withheld for privacy reason).

AT&T has allowed my soon-to-be ex-husband access to my account throughout our entire divorce and I still have to pay for his phone and line he left without my permission. They let him keep moving my acct info which gives my minor children access to adult content. Violates all policies, includes identity theft, and violates Hippa for all 3 of us, I pay $280 a month for 6 lines and can only use 2 half the time, and am told to factory reset and lose all my information. I have to maintain service because my 2 special needs children are online school and in a divorce that I’m getting demolished in, and they just allow him to keep on because they don’t have his apple password but they continue to service a man breaking their policy and the law. Apple is doing the same thing as AT&T. They say his Apple ID is his so if he left an old phone with it on it and it was connected to your phone service then he has to disconnect it. This is outrageous. They say I have to delete all of my phones to get him off. The Apple ID may be his but the information I will lose is mine! All phones and services are bought and paid for with receipts by me.
