  Wrongful eviction dispute
Posted by: josephpinnock - 07-22-2022, 05:37 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

I had already sent in some basic information through our form and I received an email from your team this morning. The email told me that there is usually a $150 charge to start the case and it will be pro bono so you won't receive any payment until the case is resolved. Can you waive the fee?

I was wrongfully evicted from my apartment and they also towed my cargo van that I use for work. I am a business owner so I am self-employed. I had a cargo van for work but the rental expired on it so I was trying to get it registered. It was bought in a different state so when I went to the DMV to get it registered, they were unable to get it done so I had to contact the lender Chrysler Capital to get some documents to be able to get the van registered. They towed the vehicle on September 10, 2022, and they also auctioned it.

I lived at the Village Oflionstone Apartment. Because of Covid, my business took a tremendous loss and I had to go on a moratorium since I was unable to pay the rent. I also signed a form so that they couldn’t evict me. The moratorium was for 6 months so it lasted from April 2021 to September 2021. They kept on giving me eviction notices but when the moratorium ended, they brought me to the El Paso County Courts for late fees on the 21st of April 2022. They took me to court for 2 late fees and 3 months’ insurance which added up to $186 because it was $75 for the late fee each and I had to pay $12 per month for the insurance which is also apart of the late fee.

When I was at court, I was unable to speak because the magistrate kept interrupting me. I now have an attorney because I filed for an appeal of the judge’s decision. I found out landlords cannot bring tenants to court because of late fees so I did the appeal and it is now under review. If I didn't appeal the eviction then I wouldn't get anywhere to live because I would have an eviction on my file. They kept adding on to the late fee to add it up to $517 which they lied to the court about. When the judge asked what the $517 was for, they said that it is for rent. I usually pay $1210 for rent per month and I also had to pay for utilities. I was homeless since April 28, 2022, and had to stay in a hotel with my daughter which cost over 50 thousand dollars. I just moved into an apportment. I found out that the apartment complex broke a rule and under the law, it states that they can be fined up to 250 thousand dollars. I need your help because of the damage that was done and also have all the documents in my storage.

I was sent an email from Shipt HQ informing me that I had been deactivated
Posted by: Donesia - 07-22-2022, 04:31 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

In late April 2022, I was sent an email from Shipt HQ informing me that I had been deactivated from the platform for alleged violations of the terms of service as outlined the independent contractor agreement that I had entered into when I started working as a shopper / delivery driver on the platform about a year prior. At the end of this email was a link to an appeal form that I filled out a few days after deactivation, offering my side of the story and explanations for why I believe I was terminated unjustly (I explained that the algorithms used to detect possible fraudulent behavior were not calibrated correctly, and that an actual human review of my data would show that there was no reason to deactivate me.)
I never once heard back from Shipt, despite numerous requests for an update via phone and email in the weeks that followed the appeal.

I went as far as to mail their legal department in San Francisco a certified letter explaining that I was prepared to initiate formal arbitration proceedings (as provided in the aforementioned agreement) if they were not willing to provide me an audience to discuss my sudden deactivation; the letter was ultimately sent back to me after they refused to accept delivery of it on multiple occasions.

I am wondering if I have any recourse in the matter, given the fact that they don't appear to be willing at all to engage in a good faith exchange. Please note that there is a clause in the agreement that stipulates that SHIPT and I "mutually agree to resolve any justiciable disputes, past, present, or future, between the Parties, or between [me] and any of SHIPT's employees, agents, parents, subsidiaries, affiliates, successors, or assigns, exclusively through binding arbitration instead of a court or jury trial."

If it makes any difference, I am located in California, a state in which I may still be protected by Prop 22 (2020), which grants certain rights and protections for app-based drivers like myself; the Proposition was ruled unconstitutional in August 2021, but is currently going through the appeals process.

  Non-physical injury automobile accident
Posted by: Donesia - 07-22-2022, 04:27 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

This concerns a non-physical injury automobile accident in the city of Visalia, California, on May 6, 2022. The matter at issue in this case is that the intersection in question, E. College Avenue and S. Vista Avenue, was unmarked in any direction, despite the testimony of local witnesses who stated that such signage had been there previously and that there had been a number of accidents since they were removed (there were no witnesses of the actual accident).

We brought the matter up to the city since we felt they basically put our lives at risk by their faulty decision-making, and they made no admission of guilt or regarded our concerns.  We were, in fact, told that they had no responsibility to place signage at this intersection. The problem with that remark was that the city was actually placing stop signs at that intersection at the very same time that they were denying their need.

Lawsuit against water company for overcharging me
Posted by: josephpinnock - 07-21-2022, 08:26 PM - Forum: Past or Current cases - No Replies

I want to see what it takes to file a lawsuit against a water company. They are overcharging me on my water bill and they don't credit the payments I make towards my bill. Great Basin Water Co. In Pahrump Nevada. They are sending me bills that range from 1,200 to 1,400 dollars. I have lost 5,000 dollars in grass and trees. I want them to be held responsible for what they are doing. It started about 2 years ago. I figured if I kept giving them money the overcharging would stop but it hasn't. I can't remember exactly how much I was paying before the overcharge.

Injured person refused public transportation after paying the fare
Posted by: josephpinnock - 07-21-2022, 01:00 PM - Forum: Past or Current cases - No Replies

On July 19th, 2022 between 5 pm to 5:15 pm bus number 3106 to Newport news arrived late and the bus driver refused to allow me to ride the bus with my folding e-bike. The wheels are too big to put outside on the bike rack so I have been allowed by other bus drivers to use the handicap spot and secure my folded bike as anyone would do when using their transportation (electric wheelchair or scooter) to get around. I also have an injury where my bike is my form of transportation for the moment and am out of work for a while also I have a medical condition. The bus driver wouldn't help me lift the seat to secure my bike. He also let me on the bus and I paid my fare and he then said get off I cant ride. I did not get off the bus then because I felt my rights were being stifled he then got the assistance of the security guard who then came on the bus saying you... he she it...w/e I need you to step off the bus. the passengers then shouted she. He and the bus driver then kicked everyone off the bus because I felt my rights were being violated. I live in Newport News and had a doctor's appointment about my leg I was coming from VA beach. where I had just gotten off of the bus with my bike. I also went across to VA beach on the hrt with my bike on more than one occasion. I felt discriminated against and robbed. He also refused to give me his name.

Legal help for my mother's death
Posted by: Donesia - 07-20-2022, 09:05 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

I wanted to get legal help regarding the death of my mother. My mother passed away about a year ago. She got sick and was feeling weak so she was taken in an ambulance to the Providence Holy Cross Medical Center in San Fernando on Jan 6, 2021. When she got to the hospital she had to get blood, IV, oxygen, and medication. The doctors took care of her and she was feeling okay. My mother told the nurse that she wanted to go home and didn't want anything else to be done to her. If anything was supposed to be done to her then the hospital needed to contact her two daughters. They didn't let my mother go home or contact my sister who was in charge, instead, they called my mother's house and spoke to my brother who took everything over by lying that he was her caretaker. My brother did drugs and was staying with our mother. My mother could have visitors but they never told her so we didn't get to see or speak to her. They said too many people were calling which was not true. When I called the hospital they informed me to speak to my brother to find out about my mother. That same night when they called and spoke to my brother they told him that our mother wanted to come home and to have my sisters pick her up from the hospital.

The next day they called and spoke to my brother again who told them to go ahead with whatever they wanted to do to our mother but nobody knew what they wanted to do. Her brother didn't have any right to make decisions, if the hospital wanted to do something, then they should have spoken to the sisters. My brother lied that our mother had Covid but that was not the case. My mother was hospitalized for about a week before she was released to die at home. She died on Jan 15, 2021. The hospital said she was in pain so they had to give her medication to make her more comfortable. They also wanted to stick a camera inside her to see where the bleeding was coming from but she was not bleeding. She had a colposcopy about 5-10 years ago and had to carry a bag on her stomach. They gave her so much medication that she was sleeping when they released her from the hospital and she never woke up. I believed that my mother died from the amount of medication that was given to her.

I have a lottery case. I was in a lottery pool in 2002 with M.W.C. It was a Starbucks lottery pool. I called her to ask why it is that everybody else got their money except me and she told me that she gave my name to the Lottery officials. I am supposed to get 97 million dollars. I just need help to get my money.

I have no email so if it is possible that you could call me or send me a text message then that’d be fine.
