For almost 4 years I've worked as a bicycle courier delivering food with Uber. Recently I was terminated due to "Fraudulent activity" which I believe to not be true.
This occurred a few days after I cancelled the second part of "stacked" order (2 separate customer orders accepted at once). Until recently, Uber would tell us both drop-off locations before accepting the job. Now, the second drop-off point is not disclosed beforehand, and we have no idea where it is going. They did not tell us about this change. When I completed the first order in the stack, I expected the second order to be in the same location shown when I accepted, but that was not the case. I cancelled it because I didn't feel safe going there.
Uber may have hid the address purposely to manipulate me into going to an unsafe environment I would not normally go to. I am on a bicycle, which increases the risk of injury to myself, so I only accept orders in a bike-friendly environment. I was misled and it could have caused injury if I didn't cancel. I did not steal food/commit fraud as Uber is claiming. I would like to be reinstated and possibly compensated for lost income.

The client wants to file a lawsuit against a doctor in Beverly Hills. He said he is trying to get this taken care of before the case is history. He said Dr. S is a type of doctor that writes letters for persons who have been injured and required a certain type of surgery. He explained that on June 21, 2006, he had a job injury where most of his body parts were destroyed. He said two vending machines, each weighing a ton, fell on him. He said on September 2022, he went to see Dr. S, and during the checking of his body, he sexually violated him. He said he laid him down in his wheelchair and was checking out his body parts, also breathing deeply in his face. He said he told him that he was going to try something and that he should let him know what he thinks. He said he undid his pants and touched his private parts inappropriately. He said being in a wheelchair he couldn't stand up to stop him. His nurse was there but he was sitting across from the doctor and couldn't see what he was doing. He said his nurse sensed something was wrong, so he got up to walk around and noticed that he had his hand on his private part. He said his nurse asked the doctor if he was touching him and told him that he was a disgusting man and doctor and that he should be ashamed. He said His nurse wanted to hit him but didn't want to jeopardize his case. He wanted to just get out of there. His nurse raised him slowly and unlatched the bar handles and buckled him back into his wheelchair. He said he didn't like the doctor touching him, he was so hurt that he cried, and couldn't stop crying. He felt uncomfortable, and he is not the first person he has done this to. He said when he thinks of him, he gives him the creeps, and to top it off, he told him that everybody liked it, but he didn't.
He said he wants a major lawsuit against him, one that could help him get the medical equipment that he cannot afford. He said it’s a leather alter strap that fits around his waist. He said the doctor has no respect for his office or anybody. What he did was malpractice, and he doesn’t like anybody touching him, and worse he is disabled.

I was a delivery driver for Uber delivery service and I was terminated on October 20, 2022. I think it is unfair and I would like to seek arbitration. They said I committed fraud, but they wouldn't give me the details of what I did. There was a mistake in my pay a few weeks before, as I was overpaid. I thought they would have corrected it and I am wondering if the fact that they made a mistake was the reason for them terminating me. I didn't commit fraud because I didn't steal anyone's food, I always delivered it, and I don't know why I was terminated.

Do you handle accident claims where the other person did not have insurance and damage was done to my vehicle?
My daughter and her boyfriend were driving my SUV when hit from behind causing at least 5000.00 dollars worth of damage, when she called her insurance company she had let her insurance lapse. This happened in June 2021, in Florida. As soon as my husband gets home I can send you a copy of the police report. It was like an SUV that hit them. I have a Ford Escape and it was similar to it. She hit the back passenger side causing a lot of damage to the tailgate and bumper. I have pics also if they need them.

How can I get information about issues with a credit card issuer that requires arbitration?
I feel my issuer is breaking the contract. I feel I have a real case against Credit One bank. Credit One is blocking online purchases and has given me no real reason why. I am able to use the card in person. I pay an annual fee for use of this card. No one will help me at Credit One. In the contract, I am able to use the card anywhere I want but they are blocking my usage at online vendors. There is no fraud, I make large payments, and I have available credit. They started on 11/16. Walmart, Target, Amazon, and Netflix. I spoke to corporate and they have no answers. They are blatantly blocking me from utilizing a card that I pay for in high fees. I can't even pay off my card to use it again because I'm afraid they will continue to decline it. It's Christmas time. People use their cards online. So I'm refusing to pay off my card because of this.

My daughter purchased a car from Gateway Autoplex in Saint Charles Missouri. They sold her this car without it having past emissions around August 18. They have had custody of this car at their shop or another mechanic shop since September 1 and the car still has not passed emissions and they are refusing to refund us or replace the car and every time we call they either say the car will be finished today or they don’t answer and they don’t return calls. Is there any way she can be helped? She paid $7350 and also was forced to pay $1000 for a new engine. They guarantee that it would pass inspection if she paid that, that was over a month ago. I would like to add they did provide a three-month warranty on this car so it was not an as-is sale as they are claiming there is no As is paperwork in her file. My daughter is a student and she is also hearing impaired so I am trying to help her out.

We were dealing with a small claims COVID rental release case in Santa Clara County, and I just received judgments from the judge in the mail stamped on the 15th of November, but it was created on the 10th of November. I currently reside and have resided in San Diego County where the property is. I am having this issue with the owner of the property. We resided at the property for 3 years. I need to get some more information on how we can put in an appeal and how we can get the logistics regarding us not receiving our security deposits and the judge didn’t get any of that information nor took any of that into consideration and putting a small claims judgment for an individual over almost $8000. Again, this is regarding heading an appeal for a small claims matter that is in Santa Clara County, but we don’t currently reside there. We lived there on a job transfer and moved back to San Diego after our entire U-Haul was stolen and we needed to get back to a safe spot, but the judge was not willing to listen to any of our concerns and made the judgment of the $8000 to be paid to the owner of the property for an individual in a small claims matter. We also didn't receive our $36,000 security deposit that was paid to her. The name of the judge is EJ and we went to the Santa Clara County Superior Court. They also didn’t submit the COVID release form to get the funds for the state of emergency that was in place back in 2020. This was submitted in the COVID amendment release that was signed and dated April 5th, 2020, and we didn’t get those funds. This appeal needs to be filed quickly and I am driving down to the court to get more details on how small claims work. I need communication from a lawyer on how to submit the appeal for the judgment as the property is in Santa Clara County and we reside in San Diego.

Sir, I purchased a Oneplus mobile from Amazon on 13.11.22, from last one day I will continue to follow up with Amazon for return. I received a defective piece of mobile camera quality, very bad and automatically switch off and on within 2-3 hrs., but they did not return my product till now, harasses me, and today is last day for return 21.11.22. I want the case file against Amazon.

I am looking for help with my insurance company Bristol West, which is a part of the Farmers Insurance Group. They had closed a claim and didn't let me know that it was reopened. They initially told me that it wasn't my fault then they changed it to my fault and I didn't know. I thought the case was closed and now when I had to renew my insurance it was really high. I have my own insurance, but my daughter had an accident and the other person involved put a claim on my policy. The final decision made was that it was nobody's fault and we both had to pay for our damages from our pocket. The last thing I heard was that the case was closed and this happened on May 21, 2022. I called my insurance company and they said the accident was my fault. They didn’t tell me the case was reopened and that the decision had changed. I have a right to know as I am paying my insurance and they didn’t tell me anything about it. I had just renewed my policy in October and I don't know why they didn’t tell me about the accident, and that the case was reopened, and give me the chance to fight back.

MINUTE entry before the Honorable Steven C. Seeger: Plaintiff Progressive Express Insurance Co. recently filed an amended complaint. It asks the Court for a declaratory judgment under 28 U.S.C. § 2201, declaring that it doesn't owe the Defendants any money for insurance claims stemming from a car crash on I-90. See Am. Cplt., at ¶ 1 (Dckt. No. [8]). Plaintiff acknowledges that it sold an auto-insurance policy to Defendant Harry's Truck Service, but claims that this policy doesn't apply to the crash for a variety of reasons. Id. at ¶ ¶ 38, 42, 46, 52. Plaintiff says that this Court has both federal-question and diversity jurisdiction. Id. at ¶ 2. This Court will put to one side (for the moment) the question of federal question jurisdiction, which seems dubious (at first blush, anyway) under Grable & Sons Metal Products, Inc. v. Darue Engineering & Manufacturing, 545 U.S. 308 (2005). If that's right, diversity jurisdiction is the only remaining jurisdictional hook, and diversity jurisdiction requires complete diversity. Plaintiff alleges that it is a citizen of Ohio. See Am. Cplt., at ¶ 8 (Dckt. No. [8]). But the citizenship of the Defendants is hazy. The list of Defendants includes an LLC, an LP, a company, a corporation, and a bunch of natural persons. For jurisdictional purposes, they stand on different footings. A corporation is a citizen where it is incorporated and where it has its principal place of business. Not so for an LLC and an LP. A limited liability company is a citizen wherever its members are citizens. It makes no difference where a limited liability company is registered, or where it has its principal place of business. For an LLC, the citizenship of its members is all that matters. See Belleville Catering Co. v. Champaign Mkt. Place, LLC, 350 F.3d 691, 692 (7th Cir. 2003); Martin v. Living Essentials, LLC, 653 Fed. Appx. 482, 485 (7th Cir. 2016) ("[T]he home 'base' of a limited liability company, or LLC, is irrelevant, given that an LLC has the citizenship of each of its members."); Thomas v. Guardmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007) ("For diversity jurisdictional purposes, the citizenship of an LLC is the citizenship of each of its members."); Cosgrove v. Bartolotta, 150 F.3d 729, 731 (7th Cir. 1998) ("[T]he citizenship of an LLC for purposes of the diversity jurisdiction is the citizenship of its members."); Fellowes, Inc. v. Changzhou Xinrui Fellowes Office Equip. Co., 759 F.3d 787, 787-88 (7th Cir. 2014). A limited partnership has the citizenship of its partners, too. For individuals, what matters is where a person is domiciled (i.e., residence plus intent to remain), not where a person is living. See RTP LLC v. ORIX Real Estate Capital, Inc., 827 F.3d 689, 692 (7th Cir. 2016) ("Citizenship depends not on residence but on domicile, which means the place where a person intends to live in the long run. It is possible to reside in one state while planning to return to a long-term residence in another state."). The amended complaint does not include adequate jurisdictional allegations, by a long shot. For example, the complaint brings a claim against an LLC, adding that its principal place of business is Florida, but its principal place of business makes no difference. Id. at ¶ 4. Plaintiff also sues a limited partnership and says that its principal place of business is Pennsylvania, even though it does not matter. Id. at ¶ 6. And it lists the residency, but not the citizenship, of the individual Defendants. Id. at ¶ ¶ 711, 1317. In sum, the jurisdictional allegations of the amended complaint are inadequate, so the amended complaint (Dckt. No. [8]) is hereby stricken. The Court grants Plaintiff leave to file a second amended complaint with proper jurisdictional allegations by November 21, 2022. Mailed notice. (jjr, )
