  Synchrony Bank
Posted by: kishana.n - 01-23-2023, 06:05 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

I have a problem with Synchrony Bank. At the beginning of last year, I was told I’m losing my eyesight. I enquired with Synchrony about activating my card security to cover the two cards I have been paying card for 10 to 15 years. Money that I paid in for that was completely voluntary. The reason for purchasing and paying that each month was to cover me in a situation of this sort. Needless to say, I found another way to eliminate those particular cards by paying them off by selling assets. I was obviously misled when signing up for the security in the first place and since I paid off the balances I feel I should be refunded the card security since they wouldn’t allow me to access it for a legitimate reason. I have several years worth of credit card receipts to examine the amounts each one was based on the exact balance. But I do have them if there’s a way I can get back to you.

  The Employee Retention Credit
Posted by: Donesia - 01-23-2023, 01:10 PM - Forum: Arbitration information - No Replies

Can you help me with the ERC?

YES! US Arbitration will file for you!
We can also arbitrate most tax disputes if needed!

ERC

The Employee Retention Credit (“ERC”) continues to provide a wide variety of employers with lucrative refundable payroll tax credits for qualified wages paid to employees in 2020 and 2021. Businesses can still apply for the ERC by filing an amended Form 941X (Quarterly Federal Payroll Tax Return) for the quarters during which the company was an Eligible Employer.
“We have helped hundreds of employers receive the ERC over the past two years since the credit was introduced. We have not seen a slowdown in application approvals by the IRS,” says Martin Karamon, principal at Cherry Bekaert who leads the Firm’s ERC Team.
“Even though employers can only assess their Eligible Employer status from March 13, 2020, through September 30, 2021, we are seeing record numbers of our clients being approved to receive the ERC,” Karamon adds. “Unfortunately, many companies still have not evaluated whether they qualify for the four separate credits.”
Check If You Qualify For ERC
As we reach two years of ERC availability, Karamon and his team answer the most frequently asked questions about this payroll tax credit.

Table of contents:
• How does the Employee Retention Credit work?
• Who qualifies for the Employee Retention Credit?
• What are ERC qualified wages?
• Are benefits of the Employee Retention Credit the same for large and small employers?
• How do I calculate if an employer is a large or small employer for the Employee Retention Credits?
• Is the Employee Retention Credit only for full-time employees?
• What is the ERC eligibility / credit-generating periods?
• Can I still apply for the Employee Retention Credit?
• What is the interplay between wages included in the R&D Credit and wages utilized in the ERC Calculations?
• Are most companies utilizing the Gross Receipts Test or the Government Mandate Test to reach eligibility for ERC purposes?
• What is considered Gross Receipts for ERC?
• If I qualify under the Government Mandate Test, does that automatically qualify me as an eligible employer for the entire quarter?
• Do I take the ERC into income when I receive it?
• Does the Employee Retention Credit have to be paid back?
• How do I apply for the ERC?
• How long does it take for the IRS to provide a refund after filing an amended Form 941X?
• Can I get both the ERC and PPP Loan?
• Do I need to file for PPP forgiveness before I file for the ERC?
• Does PPP forgiveness count as gross receipts for ERC?
• Can churches and other religious organizations qualify for ERC?
• Do companies owned by Private Equity Funds need to aggregate their gross receipts and employee counts together when determining eligible employer status?
• Who qualifies for ERC?
• If I use a PEO instead of a traditional payroll tax provider, can I still claim the ERC?
• What are examples that allow an automotive dealership to qualify for the ERC due to the effects of COVID-19 mandates limiting commerce, travel, or group meetings?
• Does the Receipt of Payroll Tax Refunds under the ERC Trigger Title IX for Private Schools?

How does the Employee Retention Credit work?
The ERC is a refundable payroll tax credit that can be as high as $5,000 per employee in 2020 and as high as $21,000 per employee in 2021.
Who qualifies for the Employee Retention Credit?
Employers that experienced partial shutdowns due to government orders limiting commerce, travel or group meetings; or that experienced significant declines in quarterly gross receipts (as compared to their quarterly gross receipts in 2019) due to the pandemic are eligible employers under this program.
What are ERC qualified wages?
ERC credits are calculated based on the qualifying wages paid to employees during eligible employer status. For most companies taking advantage of this program, the refundable tax credits are well in excess of the payroll taxes paid by the employers. ERC benefits can be larger than the amounts a company received in PPP funding.
Are benefits of the Employee Retention Credit the same for large and small employers?
Small employers receive enhanced benefits under the ERC regime.  Specifically, for the time they are an Eligible Employer, they can include wages paid to all employees.  Large employers can only include wages paid to employees for not providing services.
How do I calculate if an employer is a large or small employer for the Employee Retention Credits?
• For the 2020 ERC, an employer with 100 or fewer average full-time employees (as measured in 2019) is defined as a small employer.
• For the 2021 ERCs, an employer with 500 or fewer full-time employees (as measured in 2019) is defined as a small employer.
• The term “full-time employee” means an employee who, with respect to any calendar month in 2019, had an average of at least 30 hours of service per week or 130 hours of service in the month (130 hours of service in a month is treated as the monthly equivalent of at least 30 hours of service per week), as determined in accordance with section 4980H of the Code. An employer that operated its business for the entire 2019 calendar year determines the number of its full-time employees by taking the sum of the number of full-time employees in each calendar month in 2019 and dividing that number by 12. Special rules apply to those who were not in business all of 2019.
Is the Employee Retention Credit only for full-time employees?
No.  An employer may include wages paid to part-time and full-time employees in the calculation of the ERC.  The only limitation on the calculation of the credits is that an employer may only calculate the credits on the first $10,000 of wages and health plan costs paid to each employee during each credit-generating period.
What is the ERC eligibility / credit-generating periods?
If eligible, employers can claim the ERC for qualified wages paid in 2020, as well as Q1, Q2 and Q3 of 2021.
Can I still apply for the Employee Retention Credit?
Yes.  The statute of limitations for the 2020 ERC does not close until April 15, 2024.  The statute of limitations for the 2021 ERCs does not close until April 15, 2025.

For 2020 credits, the return would have been due April 15, 2021, so given the 3 year statute of limitations April 15 2024,

  IRS Tax Arbitration
Posted by: Donesia - 01-23-2023, 01:03 PM - Forum: Arbitration information - No Replies

Does the IRS engage in tax arbitration with citizens?

Yes, the IRS has a process for taxpayers to dispute tax liabilities through the Office of Appeals. This process is known as "tax arbitration" or "tax appeal" and allows taxpayers to present their case to an independent appeals officer who will review the case and make a determination. The process is an alternative to going to court and is generally considered to be less formal and less adversarial.

How long does that take generally?

The length of time it takes for the IRS Office of Appeals to resolve a case can vary depending on a number of factors, including the complexity of the case, the workload of the appeals office, and the availability of necessary information. In general, the process can take several months to a year or more to resolve. Some cases may be resolved more quickly while others may take longer. It's also worth noting that the appeals process is separate from the audit process and can run concurrent with it.

  Family Dispute
Posted by: Donesia - 01-20-2023, 09:59 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

The client said he was looking for a lawyer to help with a family dispute. He said this dispute is between him and his brother. This started when his father passed away in December 2011. He said they had a verbal agreement that he would take over the equity and pay for their mother’s expenses from the equity because there was no money available after their father passed away. He said the house had a significant mortgage on it. Now that the housing price has gone up, his brother wants to break that agreement and wants 50/50.  He said he did submit a dispute on lawyersbywinrate today.

  Issue with Lemon Law
Posted by: kishana.n - 01-20-2023, 04:35 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

Hello, I am a part of Gemini and I was told to reach out to you regarding some attorney help. I am having an issue regarding lemon law and my vehicle contract being breached. It is a very long story but I will give the cliff notes version. So it all started when they sold me the wrong car in October of 2018. We resolved that issue and during my first service appointment in early 2019 I complained about a tremble when sitting idle. They checked and said they couldn't duplicate the issue. I then proceeded to complain about this issue pretty much every service appointment only for them to respond with everything was fine. Last September I had to bring my car in for the big service appointment to change the transmission fluid and other things. I was hesitant to do it as I had already been experiencing issues but they said if I didn't get it done that my lifetime powertrain warranty would no longer be valid. So I complied and set the appointment. When I arrived they asked if I was having any other issues that I would like them to check out during this service appointment. I brought up the tremble again to the service guy that I typically go to every visit. He stated that he remembered me complaining about it for awhile and asked for some more details. Once I explained he said that he had a Tahoe himself and that it was definitely not normal. I expressed that I knew that which is why I kept complaining about it. He said it sounded like motor mounts which was very strange to me as those hardly ever go bad. Come to find out they were bad or so they said. He told me it would take some time to get them in so I could take my car and it wouldn't cause any further issues until they came in to change.

I said ok made the appointment once they came in and when I came back to pick it up I was furious. As I was pulling out of the dealership the car was shaking terribly. About ten times worse than before and I was now having issues when I was braking. I called immediately and turned around. I asked if they test drove it and they hadn't. Another long story short I had to leave it for the weekend with now loaner car for any of these visits. I called my service tech on Sunday to see if it was ready to pick up and he told me it was but they had received another set of bad motor mounts and that's why it was so bad. I picked it up as instructed and didn't hear again for about a month. I then called to check in only to find out they still didn't have the part. Another month went by and I called again. This time only to find out that TWC didn't want to cover anything without having the vehicle present for inspection. I was extremely frustrated as this hadn't been told to me. Another week or so went by and I called again. At that time I found out that they put an aftermarket part on my vehicle and TWC won't touch it. So now it has been another month and a half and my car is still not fixed and is progressively getting worse. I am extremely frustrated and need to have this resolved. I am sorry it is so long but it has been a very long and tiresome process. I have talked with a friend who owns a couple dealerships and he said I needed to talk to a legal team ASAP.

  Help with child custody
Posted by: kishana.n - 01-17-2023, 07:11 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

I am about to go through child custody with my 5-year-old daughter SL's father, JT. I need a lawyer to represent me and someone who will be a very aggressive lawbreaker. I had to call the police on him on New Year's Day. He is a non-diagnosed alcoholic bipolar. He is very evil, and he got a lawyer to continue his aggressiveness towards me and our daughter, so I want somebody that will also be aggressive with him. He has made a lot of poor choices and blames me for that, then uses our daughter as a tool to get back at me. Our daughter doesn't want to live with him. I have a lot of information on him, and years ago he said he would sign over full custody to me. He didn't want anything to do with her, now for his ego he wants to take her from me. His name is not on the mortgage or any bills, and he doesn't pay any bills. He propositioned me for sex before if he was to pay the utility bill and he said he would accept payment if he had to mow the lawn because it looked very bad. I had a back injury and had to mow the lawn while I was 40 weeks pregnant. He never spent time with our daughter or went to anything for her and then blamed me.

He had an axe in his closet with 1 liter of vodka, and he said he didn't have any alcohol. His mother was also diagnosed with alcoholism. People I had spoken to said it didn't happen in the last 6 months but that doesn't make any sense. He is an atheist and if I mentioned the word God in the house, he would start shaking. He doesn't want our daughter to learn about religion and he once threw her on the floor and then threw her in the bed and she had red marks on her hand from the way he grabbed her. He screamed at me on Christmas Eve because he said I used the wrong color wrapping paper for our daughter's gift that was supposed to be from both her parents and not Santa. He even freaked out about this and sent pictures of the wrapping paper to his lawyer. He has a major psychological problem. He has even screamed at his mother in front of us before. He has also lost it with his old boss, and his current boss, and he freaks out if he doesn't get his way. I have all the information.

He even screams at our daughter, and I am scared to have her live with him. I have no idea where he is living now. After New Year's Day when I called the police, he was holding our daughter hostage in her room. After I called the police, he then called the police. They asked him to leave the house for the night and he said no, so they asked me to spend the night at my sister's house with our daughter. When I came back the next day he didn't come home from work, and he didn't call for 3 days to even talk to his daughter. He finally came to get his things by police escort and suddenly he wants to see her every day and wants to spend time with her. I think it's the lawyer telling him what to do. He makes a lot of money, more money than I make.

  Help with divorce case
Posted by: kishana.n - 01-13-2023, 09:46 PM - Forum: Past or Current cases - No Replies

I am looking for an attorney to represent me in a divorce case with my husband JW. He was the one that filed for divorce, he is the plaintiff and I am the victim here as he raped me and the case also involves domestic violence. We have been married for almost 24 years, it's about 23 years and 9 months. He is currently living with his girlfriend while I am living in 1 of our 3 houses. We have 3 houses in total in both of our names. We have adult kids who would be living with her, so minor would be involved. We have been separated since January or February of 2022.

We have a lot of debt, as we have a business we run together. We also have cars, a boat, and a motor home. We plan to split the cars and sell the others as we have been working through some stuff. We owe a FBA loan of $146,000, a credit card total of about $50,000 and we have mortgages on 2 of our homes. A case was already filed in the Superior Court East County Division at 250 Main St, El Cajon, California 92020 in February 2022. I didn't want to ask for alimony, but I would in the case where I got sick. He wouldn't be able to ask for alimony against me because of domestic violence. He might not even be able to take care of me if I got sick as he is under investigation by the DA office and he might go to jail.

  Help with the DMV
Posted by: Donesia - 01-10-2023, 04:38 PM - Forum: Past or Current cases - No Replies

Here is a previous case by *** (Identity withheld for privacy reasons).

I'm a resident of Florida for 32 years and had my driver's license here before. I waited too long, and my driver's license expired, and when I went to renew it, all these other problems arose. I was informed by the state of Florida that there was a citation for me in Maryland. The citation number was XXXXXX which was issued to me on Jan 8, 1988, but I don't know what it was for. I have never had a driver's license in Maryland. Maybe I drove through there. To get the issue taken care of, I would need to make an appointment with the Florida DMV, but I don't have the time to take off from work to do that. I was also informed that I would need to get my name removed from the National License list to have my driver's license renewed in Florida only. You can text/call me and I would also donate to your cause.

  T-Mobile data breach
Posted by: kishana.n - 01-06-2023, 06:26 PM - Forum: Arbitration questions - No Replies

Here is a previous question that was asked by *** (Identity withheld for privacy reasons).

I have some questions. Is the company doing something regarding the T-Mobile data breach?

T-Mobile has an opt-out option, so you can opt-out within 30 days of service. When you start a new line with T-Mobile, Sprint (I believe Sprint is now a part of T-Mobile) they used to have their stores, and when we go in and get a new phone, you would need to sign paperwork agreeing to their terms and services. Within the terms, an arbitration clause is included. Other places like Simple Mobile and Boost don't make you sign a document. Would it be the same with the arbitration clause for other lines or would it just be for T-Mobile?
