Patent civil litigation

Here is a previous case by *** (Identity withheld for privacy reasons).


I'm seeking a lawyer who has experienced in patent civil litigation. I have a court case coming up on March 11th at the Contra Costa County Court in Martinez California, department 21, and needed an attorney to go with us to the hearing. Our case will be at 8:00 am when Judge XXXX will hear where each side is and set a date for the trial which could be a year from now or within weeks.


My partner and I had a company named Pure Power Incorporated which had three US patents. Someone reach out to express interest in purchasing our patents. We had the sale agreement reviewed by our lawyer who saw nothing wrong so we signed the agreement in Dec 2018/Jan 2019. The agreement was furnished with a payment guaranteed. After selling our patents the purchaser has been operating every day since. He bought a 3 1/2-million-dollar building in Reno and said we would have gone to Reno to operate. He developed Hammons Enterprise in Pittsburg California, using the website gopurpower.com. He is using our company's name but we didn't sell him the company only the patents. He took our patents, drawings, and customers. He is using our patents which he hasn't paid one cent for.

He had agreed to pay us 5.2 million with a down payment of 1.4 million but instead, he paid us 1.2 million for the down payment and we are still owed for a lot of admin things including salary. We were supposed to be consultants in which we train them on the product, how to handle the customers, and introduce them to certain connections we had made. We were supposed to work for 3 years and the money we were to be paid was a part of our sales price. We agreed to be paid each $2884.62 per week but we were only paid for about 3-4 weeks so the company still owed for several weeks. We worked for six months. We were called one day in a conference room at the Pittsburg office and were given an addendum to signed. The addendum was for us to work for half the amount we had agreed upon and if we didn't sign it, we could not remain on his property. I took the addendum to my lawyer which he advised against us signing it, so we didn't. We were escorted to get their personal properties, then to our car for us to leave. We never went back there. Living and working in Pittsburg in June 2019 he had agreed to pay our lease, phone, and utility which he didn't. I  the paperwork that showed he had agreed to it. I also have the paperwork for our agreement.

The company has shorted us and they said they will not be paying a cent. My partner and I are 80 years old, both had cancer, and recovered but are unable to work. All we have is our social security so we are desperately in need of the money we are owed. Because the court hearing is on Mar 11th we are going up on the 9th to Martinez and will be there for the 10th and 11th if the attorney wants to meet with us in person. Otherwise, we lived in Bakersfield Ca and can meet a lawyer in Bakersfield or someone in the San Francisco Bay area.
