Family dispute--issue with seeing my mother and I have POA

Here is a previous case by *** (Identity withheld for privacy reasons).


I filled out an information form on the website yesterday and she had someone named "R" leave me a message regarding my case.

I have POA over my parents and Covid was hitting the nursing home pretty bad that they were staying, my mother's health was being affected so I allowed her to go stay with my sister who is now refusing to return her or allow her to go to her specialist appointments. My mother is diabetic and she didn't look healthy, so my sister begged me to let her take our mother out of the nursing home. I didn't want to do it because we didn't get along but everybody was on board, nieces and nephews said it would be fine since it was a temporary arrangement.

I went to the house to pick my mother up for her foot appointment and my sister had the door locked and wouldn't let her come out so I called the police. The police came and "D" of the Tulare County Police Department went inside to talk to my sister. He later came out and informed me that he spoke with my sister and that my mother looked fine. He also used to be a paramedic and her feet didn't look swollen. He asked my mother if she wanted to come with me and she said no. The police told me if he was me, he would get conservatorship because the POA was not enough. My mother has dementia and she is unable to make decisions on her own that's why they paid the money for me to get POA over their medical, their finance, and their trust. I have no reason to be fighting with my sister. I should have the right to make a decision where she is not able to stop me and I should be able to put my mother back in the nursing home where we all can see her and take care of her.

I called adult protective services in Nora and the supervisor lady said under no circumstance the police should have made that call, saying my mother was fine and that she didn't need to see a doctor. This is the 3rd foot appointment my sister has caused our mother to miss and she is at high risk of her feet being amputated because of her diabetes. May of this year makes it's one year now since my mother has been living with my sister, communication between us has not been good, I'm frustrated and just want to take back charge and not allow this to happen anymore.

I wanted to also file a lawsuit against the police officer because who was he to make the call he did but I wasn't sure what my options were. I have the document to confirm the POA for my parents and I would like to get some help with this.
